MW Bkrpt1C: Greetings!
MW Bkrpt1C: JWH.. Ima.. welcome!
MW Bkrpt1C: What's on your minds tonight?
Imayankee: thanks. hello
Imayankee: roommate questions.
MW Bkrpt1C: Relating to credit, Ima?
Imayankee: LOTS of credit card debts. his.
MW Bkrpt1C: Yes?
Imayankee: let me first tell you that we jointly purchased a home 3 years ago.
MW Bkrpt1C: okay.
Imayankee: if he files chapter 13 or bankruptcy, will that affect me?
MW Bkrpt1C: How much equity does he have built up in the home?
Imayankee: not sure.
Imayankee: can i find this out?
MW Bkrpt1C: Did you guys put down a big down payment or a little one?
Imayankee: $3500.
Imayankee: my check
MW Bkrpt1C: She he really didn't put any money down.
Imayankee: correct
MW Bkrpt1C: With 3 years of payment, probably litlte or no equity built up.
MW Bkrpt1C: Hi SLF.
SLF10: Hello
Imayankee: that's what i figured
MW Bkrpt1C: He can probably do a chapter 13 or chapter 7 without affecting you, as long
MW Bkrpt1C: as he doesn't declare his mortgage as a debt he wants to discharge.
Imayankee: difference between 13 and 7?
MW Bkrpt1C: Ima.. with a 13, he sets up a repayment plan with a trustee and works to pay off
Imayankee: like a credit counselor?
MW Bkrpt1C: the debts over aboaut 3 years. With a seven, the unsecured debts (credit
MW Bkrpt1C: cards) are whipped o ut and the secured debts are either repossessed, or
MW Bkrpt1C: exempted.
MW Bkrpt1C: .Ima. sort of, but they have more control. Interest rates are frozen
MW Bkrpt1C: immediately; you can get alimony and child support set up on a payment
MW Bkrpt1C: schedule and you can get the IRS off yoru back (no more penalties of you
MW Bkrpt1C: have taxes to pay.
Imayankee: so he starts back at zero?
MW Bkrpt1C: Greetings KHunter!
MW Bkrpt1C: Ima.. basically, with a chapter 7, yes, he starts back at zero. Are all his
MW Bkrpt1C: debts credit card debts?
Effie lin: Hi, Paula
MW Bkrpt1C: Effie***
Imayankee: mostly. he has a truck loan, and small medical bills. biggest problem is he can't stop
Imayankee: charging stuff.
MW Bkrpt1C: He could lose the truck under chapter 7. Has he looked into debtors anonymous?
Imayankee: no. who are they?
MW Bkrpt1C: They are a nationwide organization, like AA that is for people who can't stop
MW Bkrpt1C: overspending.
SLF10: MW I would like to ask a question when your done with Ima...questions.
Imayankee: sounds like the ticket for him!!!
MW Bkrpt1C: slf... jump right in.
Imayankee: don't want to hog all your time. thanks for help. will try to check back in for more
Imayankee: advice another time.
MW Bkrpt1C: Ima.. to contact DA, you can have your roomie send
MW Bkrpt1C: a SASE to Debtors Anonymous, PO Box 20322
MW Bkrpt1C: New York, NY 10025.
MW Bkrpt1C: They can help alot!
MW Bkrpt1C: SLF.. go ahead...
MW Bkrpt1C: Anybody else wanna jump in with questions?
JWH SAH: Me
SLF10: Thx. I've file chapter 7, and my credit cards debt are wipe out, but would like to get my
MW Bkrpt1C: JWH.. go ahead!
SLF10: credit back in order
MW Bkrpt1C: When did you file your chapter 7, SLF?
Imayankee: by the way, he had a doctor tell him he had a disease that caused him to spend money
SLF10: in Nov. 96
MW Bkrpt1C: Ima... compulsive spending is an addiction.. which makes it as much a
MW Bkrpt1C: disease as alcoholism.
Imayankee: dr gave him a prescription! spending more $$$$$$
MW Bkrpt1C: SLF.. do you have any other debts?
MW Bkrpt1C: Ima... I think your roomie needs a new doctor!
SLF10: home mortgage
MW Bkrpt1C: Are you current on the mortgae, SLF?
Imayankee: me too!!! he got orrended when i suggested that
Imayankee: offended
SLF10: no
MW Bkrpt1C: What disease did his doctor tell him he had, Ima?
Imayankee: not sure
MW Bkrpt1C: How far behind are you in the mortgage, SLF? Any other debts?
SLF10: 6 months, other debts were being made with the min.
MW Bkrpt1C: So all the other debts were dishcarged, SLF?
MW Bkrpt1C: Has your mortgage lenders initiated any action against the past due payments?
SLF10: Yes, Can I establish my credit if I re-affirm with the bank even thou I file bk ?
MW Bkrpt1C: Deer.. welcome! Didn't see you lurking in the corner!
MW Bkrpt1C: SLF.. yes, but only if they haven't already taken the house into foreclosure.
SLF10: bank has begun its foreclosure
MW Bkrpt1C: Did you like your bk attorney, SLF?
Deerblue: Glad you are here. I'm so angry at myself for getting in such debt, around $43,000!
MW Bkrpt1C: Did they set a foreclosure date?
SLF10: yes and no....no date set yet.
MW Bkrpt1C: Deer... go easy on yourself! You're not alone! What type of debt is it?
MW Bkrpt1C: Credit card?
MW Bkrpt1C: SLF.. glad you liked your bk atty. I recommend calling him tomorrow to make an
MW Bkrpt1C: appointment. To save the house, you're probably going to need to file for
MW Bkrpt1C: Chapter 13.
Deerblue: 401 K consolidation debt, car loan and a new credit card. Don't consolidate!
SLF10: thx.
MW Bkrpt1C: SLF.. the chapter 13 will let you reage the mortgage and start fresh,
MW Bkrpt1C: making your regular payment, plus a little extra to pay off the past due amount.
MW Bkrpt1C: Deer... How much of the 43k is the car loan and how much is the credit card?
Ritastar: Hi, Effie
MW Bkrpt1C: Greetings Rita.
Ritastar: Hey, everybody!
MW Bkrpt1C: JH.. you never said what was on your mind!
JWH SAH: I didn't want to butt in
Deerblue: car loan $20,000, credit card $8,000, 401 k $15,000
MW Bkrpt1C: JW.. I generally have 3-4 conversations going at one time.. my fingers are
MW Bkrpt1C: atrophying from lack of exercise!
JWH SAH: Well, I had perfect credit before I was married, but since then (19 months) credit is bad.
MW Bkrpt1C: Deer.. what are the interest rates on the car loan and credit card and are you
MW Bkrpt1C: current on them?
MW Bkrpt1C: JWH.. describe BAD for me....
JWH SAH: Right after we were married we bought a second new vehicle.
JWH SAH: We got way behind on credit card and loan payments, In Jan my car was repossessed.
JWH SAH: We had 2 other loans with the same bank and had to use all our money from some stocks and
Deerblue: car loan is from credit union at 8%, current on all bills but hate living in debt
JWH SAH: tax return to pay all 3 loans up and get my car back.
MW Bkrpt1C: JW... okay.. we'll need to get that straighted out! Where are you now on
MW Bkrpt1C: payments and how much debt are we talking about?
MW Bkrpt1C: Deer.. okay.. then you're in pretty good shape. How much income do you
MW Bkrpt1C: have each month and what are the monthly payments on the debts?
MW Bkrpt1C: JW.. okay.. so you're current now?
JWH SAH: Well just as soon as I got my car back our truck was repo'd, and not able to get back.
JWH SAH: Well, since then, for last 8 months I have paid all bills on time and reduced debt from
JWH SAH: about 5,000 to about 1,500 plus my car loan. We have not had much success dealing with the
JWH SAH: bank with the truck repo and thought they would sue us for the 2,500 defieciency. But just
MW Bkrpt1C: JWH.. you need to congratulate yourself on getting 3500 in debt paid off in 8 months!
JWH SAH: this week they set up a 36 month payment arrangement to pay 70 a month to pay off.
Deerblue: Monthly income $2800, car $569, 401 k $452, cc minimum $170. Paid $500 last month on cc
JWH SAH: I now have a good spending plan I keep on the computer and I keep track of every dime we
JWH SAH: spend.
MW Bkrpt1C: JWH.. that's great! I'm glad they were interested enough to work it out for you!
MW Bkrpt1C: JWH.. I do the same thing on my computer!
JWH SAH: My mother suggested filing bankruptcy for the rest of my debt but since I still have some
JWH SAH: credit don't you think that would be unwise?
MW Bkrpt1C: Deer.. you're doing a fabulous job of paying off that debt, then! Do you have
MW Bkrpt1C: a strategy for paying down the debt?
SLF10: seen your bank list on secure credit cards, how long does one wait to apply to them, since
SLF10: I'm afraid of an emergency coming up and I'm without $$ to pay for it.
MW Bkrpt1C: JWH.. You're doing such a good job of paying off the debt, and seem to be
MW Bkrpt1C: back on track.. I dont' think bankruptcy would be a good idea, as long as you
MW Bkrpt1C: can get by okay paying down the debt.
MW Bkrpt1C: JWH.. How does paying down the debt feel to you?
JWH SAH: Great, my husband and I have not incurred and new debt and now only pay cash, we have since
MW Bkrpt1C: SLF.. I generally recommend getting a secured credit card only when you
MW Bkrpt1C: need it to pay for things that you can only buy on credit, so it makes life
MW Bkrpt1C: easier for you.
JWH SAH: also bought a new dryer and furniture, all with cash we saved up.
MW Bkrpt1C: If you only want the credit to have money for emergencies, you're better off
MW Bkrpt1C: putting the money you save up for the security deposit into a savings
MW Bkrpt1C: account at your bank for the emergencies.
JWH SAH: The only thing now is that we really need a 2nd vehicle (used is fine) and would like to buy
MW Bkrpt1C: JWH.. Then I'd say steer clear of bk. You're on the right track and you'll be
MW Bkrpt1C: out of debt in no time. All the good payment history after the repo will rebuild
MW Bkrpt1C: your credit all by itself.
SLF10: thx.
Deerblue: 401K and car loan are closed end loans, will be paid off in year 2000.
MW Bkrpt1C: SLF.. you're welcome!
JWH SAH: a house, but the repo is still active. Do we have any chance of getting reasonable loans?
MW Bkrpt1C: JW... you can probably buy a good used car simply by saving up cash too,
MW Bkrpt1C: the same way you did with the appliances!
MW Bkrpt1C: Deer.. Sounds like you've got a good plan for getting out of debt within 3 years!
JWH SAH: What about a mortgage, it will take a long time to save the 15-20% required for our credit
JWH SAH: record.
MW Bkrpt1C: JW.. Keep saving money, first for the goal of getting the used car, then for
MW Bkrpt1C: saving for the down payment on your home.. within a year, you'll have good
MW Bkrpt1C: credit in front of the repo and you'll be on your way to being a homeowner!
MW Bkrpt1C: JWH.. how much house are you looking to buy?
JWH SAH: Well, we were making 50,000 a year combined, but we are fixing to move back to our hometown
MW Bkrpt1C: Rich.. didn't see you lurking there! Greetings!
Deerblue: Thanks but I'm angry because I'm 37, in debt and friends are buying homes and I can't save
JWH SAH: and will not make nearly as much, maybe only 30,000.
JWH SAH: Maybe like a 70,000 home?
JWH SAH: Just simple for our first one.
RICHSHEU: Hey
MW Bkrpt1C: Deer.. look at it this way.. they're buying homes with mortgages. They're
MW Bkrpt1C: getting big cars with big car loans or lease payments. They're living
MW Bkrpt1C: paycheck to paycheck, and building up credit balances too.. one day, they
MW Bkrpt1C: may find themselves unable to meet their payments. You on the other hand
MW Bkrpt1C: will have paid off your debts. When you buy your house you'll be in much
MW Bkrpt1C: better shape!
MW Bkrpt1C: JWH.. you can buy a house with an FHA mortgage and put down as little as
MW Bkrpt1C: 3% of the loan amount. That's $2,100!
JWH SAH: I know how you feel dear. Since I am newly married it is hard not haveing all the things I
MW Bkrpt1C: How long would it take you to save $2,100?
JWH SAH: want, and we have to get by on 1 car, meanwhile others are getting really nice stuff, but
JWH SAH: now when I buy my stuff is paid for and I don't have to worry about people taking it away.
Deerblue: You made me realize that I'm doing the best I can. Thanks for your support!
SLF10: Are there any limitation on buying a home, if you are in bk ?
MW Bkrpt1C: JWH.. As a newly married person myself.. I can relate to wanting lots of
MW Bkrpt1C: things.. but I'm excited that within a year we'll have my spouse's debts paid
MW Bkrpt1C: off.. then we can concentrate on getting a second car ourselves!
MW Bkrpt1C: Deer.. no problem! You're doing great! Keep up the good work and come back again!
MW Bkrpt1C: SLF... what type of limitations do you mean?
JWH SAH: Yes, MK, I have found that debt is a slave, and I desire only FREEDOM!
MW Bkrpt1C: Amen to that JW!
MW Bkrpt1C: And Please, call me Paula!
MW Bkrpt1C: Effie.. you're awful quiet tonight!
MW Bkrpt1C: Everything okay?
SLF10: I heard that you can not buy a house after filing bk, only if you deal with a private invest
JWH SAH: It is not worth having "the best" only to be so stressed out about paying for them later!
SLF10: investor to hold your mortgage.
MW Bkrpt1C: SLF.. as one who declared bk and owns a beach house with a conventional
MW Bkrpt1C: FHA mortgage fro ma conventional lender, I can tell you that's not true!
MW Bkrpt1C: Wait a year, make sure everything on your credit report is being listed
MW Bkrpt1C: correctly. Then,
JWH SAH: Paula, about the FHA, I have heard some on it and have attended home buying seminars, and
Effie lin: Yes, Paula, all is well. I listen and learn. I don't have credit card debt - just those
Effie lin: old medical bills messing up my credit. I want to buy a house to so bad
SLF10: let me understand, after a year the FHA will grant you a loan even if you file bk ?
MW Bkrpt1C: start rebuding your credit. If you're looking to buy a house, then a secured
MW Bkrpt1C: credit card is a very good start, as long as you stick with a good one!
JWH SAH: I have heard that if one year of clean credit you can usually qualify. Ihave paid everything
MW Bkrpt1C: SLf.. that's correcdt. The FHA will give you a mortgage within a year.
JWH SAH: on time for 9 months, but at the current payment on my repo it will not be paid off for 3
Effie lin: I am paying on a car and a student loan - will that build it enough?
JWH SAH: years, will they consider it "OK" if I am making regualar payments or will it have to be
JWH SAH: discharged for a whole year first.
MW Bkrpt1C: JWH.. how much extra coudl you put toward the repo pay off each month to
MW Bkrpt1C: get it paid off sooner?
MW Bkrpt1C: Effie.. absolutely!
JWH SAH: Well, right now it is up in the air since I have not got a new job were I will be moving,
Effie lin: I am not a good saver. I do well with my 401K but can't seem to save money if I see it
JWH SAH: but my best guess is that it will me a minimum of 12-18 months, it is $2500.00
MW Bkrpt1C: JWH.. how long have you been paying on the repo payoff?
JWH SAH: We are just starting, we have been waiting to hear from them, had to get an attorney to find
MW Bkrpt1C: Effie.. The best thing is, you can withdraw money from your 401k for the
MW Bkrpt1C: downpayment on your primary residence, without paying a penalty (you'll still
MW Bkrpt1C: pay taxes, of course).
JWH SAH: out even how much we owed, just found out this month, we have never got their letters,
MW Bkrpt1C: I think that one year of good payments on the repo payoff should be enough
MW Bkrpt1C: to get a good track record on your crdit reort.
JWH SAH: finally was able to get an arrangement set up after 10 months!
Effie lin: Really, I didn't realize that
MW Bkrpt1C: That would be "credit report!
MW Bkrpt1C: Yup!
MW Bkrpt1C: Did that myself with my 401k!
MW Bkrpt1C: Withdrew the entire $3000 for my down payment!
JWH SAH: If they would have told us right after they sold it we could have had 9 months of payment
JWH SAH: history on it!
Effie lin: I just got a 4% raise - I was wanting to save it for downpayment - it would be easy to put
Effie lin: it in 401K
MW Bkrpt1C: Bought my house in february, and by the end of the year the tax deduction
MW Bkrpt1C: from the mortgage interest and taxes more than made up for the taxes I had
MW Bkrpt1C: to pay on the withdrawal!
Effie lin: I have $20,000 in my 401K
MW Bkrpt1C: JWH.. don't look back and what could have been. Let it go and be grateful
MW Bkrpt1C: that you have a way to pay off the $2,500 at such a reasonable payoff
MW Bkrpt1C: amount!
MW Bkrpt1C: Effie.. You're going to do great, then!
MW Bkrpt1C: Effie.. go ahead and put the pay raise into your 401k!
JWH SAH: There isn't anyway I can pay like 700 up front to go back over the past 10 months is there?
MW Bkrpt1C: Welcome KW.. BE!
Effie lin: I'll set it up tomorrow
MW Bkrpt1C: JW.. fraid not.. I repeat.. DON'T LOOK BACK. Today is a new day.. a fresh
MW Bkrpt1C: start. You're rebuilding your credit now!
BEmory8705: Hi, I just thought I would drop you a thank you line for all the help you have given me.
MW Bkrpt1C: Effie.. atta girl!
KWilson911: Do you know anything about Consumer Credit Counseling
MW Bkrpt1C: You're quite welcome, BE! I'm glad things have worked out so well for you!
MW Bkrpt1C: KW.. a few things.. what would you like to know?
JWH SAH: ok, I guess paying my other debts on time for the past 9 months will just make my credit
BEmory8705: Do you know anything about ACC Consumer Credit out of Los Angeles?
JWH SAH: that much stronger, and in 3 months I will have 2 loans paid off that will be around $250.00
KWilson911: I have over $30,000 in credit card debt - would it be a good idea to use them
JWH SAH: a month, I guess I could put that towards the house and repo.
MW Bkrpt1C: JW.. that's the way to think!!!!
KWilson911: What about bankrupcy?????
JWH SAH: All credit wounds will heal with a little time and patience! Thanks for the encouragement!
MW Bkrpt1C: BE.. nope... why do you ask?
MW Bkrpt1C: KW.. what other debts do you have? Assets? Income?
MW Bkrpt1C: JWH.. You're quiet welcome!

MW Bkrpt1C: Ima.. yup, 10-11 est.. every thursday!
MW Bkrpt1C: SLF.. you probably can get a free or low cost consultation to find out about
MW Bkrpt1C: tax penalties.
MW Bkrpt1C: If they're taking it out of escrow, wouldn't you have a tax deduction, not a penalty?
MW Bkrpt1C: Well folks.. it was a nother great class!!!! Thanks for coming!!!
